Terms of Service

1. Billing

1.1. Invoicing

1.1.1. For Domains, Invoice will be generated 14 days in advance of the due date.
1.1.2. For Domains, Invoice reminder will be generated 7 days in advance of the due date.
1.1.3. For Domains, Unpaid past the due date invoice will lead to service being terminated.
1.1.4. Immediate cancellation are processed at 0000 hours Singapore Time (GMT+8) daily.
1.1.5. End of Cycle cancellation are processed at 0000 hours Singapore Time (GMT+8) on the service next due date.


1.2. Credit

1.2.1. Existing client account credit will be automatically applied to the Cloud Hosting/VPS invoice and Client area invoice.
1.2.2. Virtual Machine will be terminated when there is not enough Credits.
1.2.3. Client account credit may only be used on our services.

1.3. Payment Method

We accept PayPal (Card/eCheck/Balance/Credit), Bitcoin, SpectroCoin, Banking (US/SG), Alipay, ATMVA, Banamex México, Banco de Chile, Banco do Brasil, Bancomer México, Bancontact, Boleto Brasil, Caixa, CashU, Dotpay, eNets, iDeal, Itaú Brasil, MOLPay, Neosurf, OneCard, Openbucks, Oxxo, Paysafecard, POLi, QIWI, Red Pagos Uruguay, Santander México, SOFORT Banking, Tenpay, Trustpay, Unionpay, WebMoney, WebPay Chile and Yandex.Money.

1.4. Chargeback / Dispute

Chargeback and Dispute will result in immediate termination of all services on the client account and without compensation.

1.5. Invoice Procession

1.5.1. Credit is added instantly when invoice is paid via PayPal, Bitcoin, SpectroCoin, Alipay, ATMVA, Banamex México, Banco de Chile, Banco do Brasil, Bancomer México, Bancontact, Boleto Brasil, Caixa, CashU, Dotpay, eNets, iDeal, Itaú Brasil, MOLPay, Neosurf, OneCard, Openbucks, Oxxo, Paysafecard, POLi, QIWI, Red Pagos Uruguay, Santander México, SOFORT Banking, Tenpay, Trustpay, Unionpay, WebMoney, WebPay Chile and Yandex.Money.
1.5.2. Service is activated instantly when invoice is paid via PayPal, Bitcoin, SpectroCoin, Alipay, ATMVA, Banamex México, Banco de Chile, Banco do Brasil, Bancomer México, Bancontact, Boleto Brasil, Caixa, CashU, Dotpay, eNets, iDeal, Itaú Brasil, MOLPay, Neosurf, OneCard, Openbucks, Oxxo, Paysafecard, POLi, QIWI, Red Pagos Uruguay, Santander México, SOFORT Banking, Tenpay, Trustpay, Unionpay, WebMoney, WebPay Chile and Yandex.Money.
1.5.3. When paying via Banking (US/SG), Credit will only be added once our billing department has verified your payment.
1.5.4. When paying via Banking (US/SG), service will only be activated once our billing department has verified your payment.
1.5.5. When paying via PayPal (eCheck), service will only be activated once it has been processed.
1.5.6. When paying via PayPal, email address of the client account must match with client's PayPal email address.
1.5.7. Client may not pay if client account is marked as fraud and necessary documents will be requested.
1.5.8. Payment will be refunded when client does not pass our verification.

1.6. Service Transfer

An active service may be transferred to another client only when the following conditions are met:
The sender active service to be transferred must be active for at least 2 months.
The sender active service to be transferred must not be overdue.
The sender active service to be transferred must not have any terms of service violations on record.
The receiver must not have an overdue service.
The receiver must not have any terms of service violations on record.
The sender has to get the security code from the receiver to process the transfer as a form of verification. The security code can be found on the receiver account.

1.7. Service Cancellation

1.7.3. No refund will be given for cancellation.

1.8. Service Termination

1.8.1. For Cloud Hosting/VPS service when is destroyed, the Virtual Machine data will be wiped.
1.8.2. For Other service when is terminated, it’ll be terminated.
1.8.3. For cPanel Kopage Website Builder when is terminated, all data will be wiped.

2.4. Abuse

Know any malicious, child pornography, copyright and illegal content hosted by us or spam bulk email originating from our server?
via resolution center.
Takedown will only be proceeded when there are valid proof.

3. Service Abuse

Our service are meant to be used in the right way.
If a client uses our service in an abusive way, all services will be terminated and no compensation will be given. The list of abusive way include but are not limited to:
* Sending Attacks / Bots to flood our service.
* Flooding our service bandwidth with Bots.
* Sending an email without the consent from the recipient.
* Flooding our service by sending bulk email to own inbox.
* Adding codes that performs malicious / harmful action.
* Adding content such as phishing, child pornography, copyright and illegal.
* Adding content that violates Singapore, France and Canada laws.

4. Limitation of Liability

We guarantee 100% Uptime of your Cloud Hosting and no data lost will occur. However we may not guarantee if the following incident happens which include but are not limited to:

Uptime
You have Shut down/Reboot the Virtual Machine
The Software on your Virtual Machine Shut down/Reboot on it's own
You have messed up with configuration on the Virtual Machine
You're Upgrading/Downgrading the Virtual Machine
When the Compute Server fails and migrating to a Failover Compute Server

Uptime & Data
Software has been exploit
You have destroyed the Virtual Machine
The Virtual Machine is destroyed when you have no available Credits on your account
Our Storage Server and Failover Storage Server goes down at the same time
All of our Uplink Providers goes down
All of our Power Generators goes down

We guarantee 99.982% Uptime of your Virtual Private Server. However we may not guarantee if the following incident happens which include but are not limited to:

Uptime
You have Shut down/Reboot the Virtual Machine
The Software on your Virtual Machine Shut down/Reboot on it's own
You have messed up with configuration on the Virtual Machine
You're Upgrading/Downgrading the Virtual Machine

Software has been exploit
You have destroyed the Virtual Machine
The Virtual Machine is destroyed when you have no available Credits on your account

2. Client

2.1. Information

2.1.1. When you register for an account, we collect your first name, last name, email address, password, country and phone number.
2.1.2. When you modify your account information, we collect the modified information.
2.1.3. Client's Information is never shared with any third party under any circumstance.
2.1.4. Client's Information is only released to law enforcement officials when a court order mandates said release.

2.2. Account Status

2.2.1. Client that has no activity for 180 days will have an inactive account status.
2.2.2. Client that has activity during the past 180 days will have an active account status.

2.3. Newsletter Email

2.3.1. When you create an account and become our client, you automatically give us permission to send you newsletter. They can be opt-out by ticking to unsubscribe from our newsletters on the client area and clicking unsubscribe on the email.

2.4. Important Email

2.4.1. You'll receive scheduled maintenance, ticket updates, terms of service updates and privacy policy updates email from us if your account status is active.
